We understand that this is an emotional and stressful time for you and your family, and we hope to provide some information that will help guide you through the process of Probate.

If your loved one lived in Augusta County at the time of their death, the Augusta County Circuit Court Clerk’s Office has jurisdiction. If they lived in a nursing home, Probate would take place in the jurisdiction they lived prior to going to the nursing home. If you aren’t sure, please contact us and we can help guide you.

"Do I have to go through Probate?”

In some cases, it is not necessary, however, if there is a Will, we do encourage you to record it, especially if there is real estate. Even if the real estate is owned jointly with right of survivorship, the transfer is not automatic, something must be put to record to transfer the real estate to the joint owner. If your loved one had assets that were solely in their name alone, with no beneficiary listed, then Probate is necessary to qualify an Executor or Administrator to access those assets.
